NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THIS CONTEST IS INTENDED FOR VIEWING IN THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW

1.  SPONSOR

The Healthier You Contest (the “Contest”) will begin on November 8, 2010, at 12:00:01 p.m. Eastern Standard Time and end on December 5, 2010 at 11:59:59 a.m. Eastern Standard Time (the “Contest Period”). Participation in the Contest constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. The Contest is sponsored by The Dial Corporation, located at 19001 N. Scottsdale Rd., Scottsdale, AZ 85255 (the “Sponsor”).

2.  ELIGIBILITY – VOID WHERE PROHIBITED

This Contest is open only to Dial Healthier You Program Members that were notified of their selection by Sponsor and provided an online toolkit by November 8, 2010 (each an “Entrant” or “you” or “your”). For information on how to apply to become a Dial® Healthier You Program Member, please click on the link to navigate to "http://www.dialnutriskin.com/signup" http://www.dialnutriskin.com/signup.html. On this page, you will need to complete the entry form and press the “submit” button. If you have been selected as a Dial Healthier You Program Member, you will receive a confirmation email from Dial by November 8, 2010, at 11:59:59 p.m. Eastern Standard Time. Each Entrant must be a person 18 or older, who is a legal resident of one of the 50 United States and the District of Columbia, excluding Guam, Puerto Rico, and all other U.S. territories and possessions. Entrants from any other jurisdiction are not eligible for entry. Also void where prohibited by law.

Employees of Sponsor, their respective parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies, printers and suppliers of promotional materials, and the immediate family members (parents, children, step-parents, step-children, siblings, step-siblings or spouses) and household members (whether or not related) of each are not eligible to enter.

Winning the Prize is contingent upon fulfilling all requirements set forth herein.

3.  HOW TO ENTER.  NO PURCHASE NECESSARY. 

To enter and become eligible to win the Prize, you can enter the Contest by completing all of the following instructions:

Sign in to your Dial Healthier You Member page at http://www.dialnutriskin.com/login and check the box next to: “I would like to participate in the Dial Healthier You Contest to win a trip to Canyon Ranch in Tucson, AZ.”

Press the “submit” button following the statement: “I have read and agree to the official rules of the Dial® Healthier You Contest.”

All entries must be received by November 8, 2010 at 11:59:59 a.m. Eastern Standard Time.

By submitting an entry, you fully and unconditionally agree to be bound by these rules and the decisions of the Judges, as hereinafter defined, which will be final and binding in all matters relating to the Contest. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the Entrant. You represent and warrant that your entries are original, that you own all title and interest to such entries, and that your ownership rights do not in any way conflict with those of any third parties.

By entering this Contest, Entrants agree that each entry becomes the property of Sponsor and that the Sponsor may use such entry for any proper purpose. Any personally identifiable information collected during an Entrant's participation in this Contest will be collected by Sponsor and used by Sponsor, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules.

4.  PRIZES:

One (1) “Prize Winner” will be awarded a five-day / four-night Spa Sampler package trip for one (1) person to Canyon Ranch in Tucson, Arizona, prior to July 1, 2011 (the “Prize”). The Prize package will include: i) roundtrip airfare for one (1) person (fees, taxes, surcharges and/or service charges are the responsibility of the passenger); if Prize Winner resides within 150 miles of Location, Sponsor reserves the right to substitute ground transportation, and ii) four (4) night hotel accommodations via the Spa Sampler package for one (1) person (hotel taxes included) at Canyon Ranch in Tucson. All travel (including air travel) and hotel accommodations are subject to capacity controls, availability, blackout periods and other restrictions, all of which are subject to change at the Sponsor’s sole discretion. Travel restrictions may apply and frequent flyer miles may not be available. Once travel is booked, no changes or cancellations will be accepted. No extensions shall apply or be available. The Prize Winner must request travel dates a minimum of 4 weeks prior to selected departure date. While Prize suppliers will make every effort to confirm reservations as requested, travel restrictions / limitations, operational and/or market conditions may prevent them from doing so on the requested dates. Prize Winner must provide own transportation for himself / herself to and from airport of departure gateway city. It is the responsibility of the Prize Winner to arrive at the designated gateway city in time for his / her flight to Tucson, Arizona, with proper travel documentation (including proper identification). Certain travel and security restrictions may apply and it is the responsibility of the Prize Winner to comply with all travel, security and other laws, regulations, airline passenger and hotel rules that apply to them. Prize Winner will be solely responsible for all other expenses not specifically set forth herein including but not limited to round trip transportation between the Prize Winner’s residence and any airport of origin, income taxes on the value of the prize, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone, in-room services, tips, gratuities and any other incidentals. The Prize will be deemed awarded upon the Prize Winner’s receipt of travel/lodging confirmation and/or vouchers. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. Stopovers are not permitted on flight voucher issued and, if a stopover occurs, the Prize will terminate at the stopover point, and full fare will be charged for the remaining segments of the flight, limited to ticketing fees, surcharges, and/or service charges not specified herein are the Prize Winner’s sole responsibility. Prize Winner must execute liability / publicity releases prior to issuance of travel documents. The Approximate Retail Value (“ARV”) of the Prize is Four Thousand, Eight Hundred and Ten Dollars ($4,810 or the “Maximum Prize Amount”), which will vary depending upon points of departure and destination and seasonal fluctuation of hotel rates and airfares. The travel, event tickets and accommodations cannot exceed the Maximum Prize Amount. The trip must be completed and the vouchers redeemed by July 1, 2011. Prize is not transferable or exchangeable and is not redeemable for cash. No Prize substitution is allowed, except Sponsor may, in its sole discretion, substitute all or part of the Prize for an item of equal or greater value or cash value in the event that all or part of the Prize becomes unavailable. The value of the Prize set forth above represents Sponsor’s good faith determinations of the values thereof. If the actual value of the Prize turns out to be less than the stated value, the difference will not be awarded in cash.

5.  SELECTION OF WINNERS

All Entrants have an equal opportunity to win. Within approximately fourteen (14) days after the end the Contest Period, the Prize Winner will be selected by a panel of representatives of The Dial Corporation (the “Judges”). The Judges shall consider such factors as; documented usage of the Dial Healthier You Routine provided by Dial Healthier You Expert Amy Hendel on the Expert’s Corner page of the Dial® NutriSkin™ website "http://www.dialnutriskin.com/experts-corner.html" (20%) (the “Daily Routine”); recognizable improvement by using the Routine when compared with your current/prior personal routine (25%); frequency of Dial Diary postings by you (25%); and exemplification of the Dial Healthier You Routine objective of incorporating a holistic approach to health and wellness into your daily life, including nutrition, skin care, adequate rest, and exercise (30%). The Prize Winner shall be chosen from among all eligible entries received during the Contest Period. The Prize Winner will be notified by email. The Prize Winner will be required to sign and return affidavits of compliance and eligibility, a liability release, and where lawful, a publicity release within three (3) days of notification, or the Prize may be forfeited and awarded to an alternate Prize Winner. Sponsor may require Prize Winner to provide proof that he or she is the authorized account holder of the e-mail address used to participate in the Contest. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the e-mail address.

6.  CONDITIONS

The Contest is governed by these Official Rules. By participating, Entrants agree to these Official Rules, and understand that the Contest results are final in all respects. All entries submitted become the property of Sponsor and will not be returned. Sponsor reserves the right to verify all entries submitted. All federal, state and local taxes are the sole responsibility of the Prize Winner, and Prize Winner acknowledges that the value of the Prize may be considered taxable income.

Participation in the Contest and acceptance of Prize constitutes Prize Winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any films or statements made by Prize Winner regarding the Contest or Sponsor for advertising and promotional purposes without notice or additional compensation, in any media now known or hereafter developed (including posting Prize Winner’s name on the Internet), except where prohibited by law. By participating, Entrants and Prize Winner agree to release and hold harmless Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, damage to a user’s system occasioned by participating in the Contest or downloading any information necessary to participate in the Contest, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Contest, or possession, acceptance and/or use or misuse of Prize or participation in any Contest-related activity and for any claims based on publicity rights, defamation, invasion of privacy or merchandise delivery. Entrants who do not comply with these Official Rules, or attempt to interfere with this Contest in any way shall be disqualified. Sponsor is not responsible for any printing, typographical, mechanical or other errors in the Official Rules or in any advertising or other associated promotional materials in connection with the Contest.

BY PARTICIPATING IN THE CONTEST, YOU AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS EMPLOYEES, AND ITS RESPECTIVE, PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, DIVISIONS, AGENTS, AND RETAILERS, AND THE EMPLOYEES, SHAREHOLDERS, OFFICERS AND DIRECTORS OF EACH FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND IN CONNECTION WITH THE CONTEST OR RESULTING FROM ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURIES, PROPERTY DAMAGE, INVASION OF PRIVACY, AND MERCHANDISE DELIVERY.

Any attempted form of entry into the Contest, other than the entry methods stated, is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. Sponsor, its affiliates, partners and promotion and advertising agencies are not responsible for: (1) lost, late, delayed, misdirected, unintelligible, or incomplete entries; (2) technical, hardware, software, electronic, network, telephone or other communications malfunctions; (3) errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, wireless phone connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion; (4) incomplete or inaccurate capture of entry information (regardless of cause); (5) any printing or technical error which may occur in processing, printing, or distribution of the Contest materials; or (6) failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an entrant’s ability to enter the Contest, including any injury or damage to Entrant’s or any other person’s computer or other relating to or resulting from participating in this Contest or downloading any materials in this Contest.

Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Contest should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor will select the Prize Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Contest and/or any associated web site. Sponsor may prohibit an Entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. Any Entrant found to be violating these rules may be prohibited from bidding in current and future auctions, in Sponsor’s sole and absolute discretion.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

7. DISPUTES.

As a condition of participation in this Contest, Entrant agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Contest, or the Prize awarded, shall be resolved individually, exclusively by the laws of the State of New York, then in effect. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorney’s fees or other such related costs of pursuing a claim. The Contest is governed by, and construed in accordance with, the laws of the State of New York, without reference to conflicts of law principles, and Sponsor and all Entrants and other related parties consent to the jurisdiction of both the state and federal courts of New York County, New York and agree to bring any actions arising out of this Agreement in such court.

8. OWNERSHIP.

All copyrights, patents, trade secrets, or other intellectual property rights associated with any ideas, concepts, techniques, inventions, processes, or works of authorship developed or created by Entrants and/or the Prize Winner during the course of this Contest (collectively, the "Creative Work") shall belong exclusively to The Dial Corporation (“Dial”) within the meaning of Title 17 of the United States Code. Entrants and/or the Prize Winner automatically assign to Dial, and shall cause its personnel, if any, to automatically to assign to Dial, at the time of creation of the Creative Work, without any requirement of further consideration, any right, title, or interest it or they may have in such Creative Work, including any copyrights or other intellectual property rights pertaining thereto. Furthermore, Entrants and/or the Prize Winner waive all moral rights in the Creative Work. Upon request of Dial, Entrants and/or the Prize Winner shall take such reasonable further actions, and shall cause its personnel to take such reasonable further actions, including execution and delivery of instruments of conveyance, as may be appropriate to give full and proper effect to such assignment.

Subject to the terms and conditions of this Contest, Dial hereby grants to Entrants a limited, non-exclusive, non-sublicenseable, royalty-free, worldwide license to use Dial’s trademarks, service marks, trade names, logos or other commercial or product designations (collectively, “Marks”) for the purposes of performing in accordance with the terms of this Contest. Dial may terminate Entrant’s right to use its Marks at any time and with no notice, in whole or in part, if the usage of such Marks does not adhere to the holder of the Mark’s then-current standards for such Marks. All use of a the Marks shall inure to the benefit of Dial and, except for the limited right and license granted above, Entrants shall not have or obtain any right, title or interest in or to the Marks.

9. USE OF DATA.

Sponsor will be collecting personal data about Entrants in accordance with its privacy policy. Please review the Sponsor’s privacy policy at http://www.henkelna.com/privacy-policy-6120.htm. By participating in the Contest, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.

The Contest may be terminated by Sponsor at any time without prior notice; provided however, the Prize will still be awarded. There will only be one Contest and one Prize.
